The user must be 15 years of age or older to visit or use jobsnorka.gov.in in any manner. By visiting jobsnorka.gov.in or accepting these terms and conditions, you represent and warrant to the Company that you are 15 years of age or older, and that you have the right, authority and capacity to use the Web Site and agree to abide by these terms and conditions. You also represent and warrant to the Company that you will use jobsnorka.gov.in in a manner consistent with any and all applicable laws and regulations.
3. Use of JobsNorka Content
The Company authorizes the user to view and access a single copy of the content available on or from jobsnorka.gov.in solely for your personal use. The contents of jobsnorka.gov.in, and of all other websites under the Company's control, whether partial or otherwise such as text, graphics, images, logos, button icons, software and other Content (collectively, “Content”), are protected under both Indian and International copyright, trademark and other laws. All the contents are the property of the Company or its content suppliers or clients. The compilation (meaning the collection, arrangement and assembly) of all content on the Web Site are the exclusive property of the Company and protected by Indian and International copyright laws. Unauthorized use of the content may violate copyright, trademark, Information Technology Act 2000 and, all other laws prevailing in the Cyber field. You must retain all copyright, trademarks, service mark and other proprietary notices contained in the original Content on any copy you make of the Content. You may not sell or modify the Content or reproduce, display, publicly perform, distribute, or otherwise use the Content in any way for any public or commercial purpose, in connection with products or services that are not those of the Company, in any other manner that is likely to cause confusion among consumers or that otherwise infringes the Company's intellectual property rights. You shall not copy or adapt the HTML code that the Company creates to generate any Content or the pages making up any Web Site which is also protected by the Company's copyright.

5. Acceptable Web Site Uses:
a. Specific Uses - Jobseekeri. Jobseeker agrees that he/she shall only use the Web Site for lawful purposes and seeking employment. Jobseeker may send his/her resume directly to any Employer who advertises on or through the Web Site. Alternatively, Jobseeker may send his/her resume to the Company through the Web Site in reply to any job advertisement. In such event, Jobseeker's resume will also remain active on the Web Site and be stored in the Company's database at his/her own risk unless and until he/she chooses to delete it. Jobseeker acknowledges and agrees that his/her resume may be accessed by employer who has subscribed to the services of the Company for the sole purpose of obtaining and assessing the suitability of Jobseekers by the Employer. The Company also reserves the right to edit any Jobseeker's resume as it sees appropriate to achieve the purpose stated herein and to erase any personal data which the Company reasonably believes that such data are inaccurate having regard to the purpose (including any directly related purpose) for which the data are or are to be used. ii. Jobseeker acknowledges and agrees to the Company's practice of charging Employer a fee for access to the Web Site, database ("Database") and Jobseekers’ resumes and details ("Resumes") for the sole purpose of obtaining and assessing the suitability of Jobseekers and subject to the terms herein. Jobseeker also recognizes that he/she shall have no claims to any such fee received by the Company. The Company will not release Jobseeker's personal data to any Employer without his/her permission. Jobseeker also acknowledges and agrees that the Company will release his/her brief resume (without his/her name, address and other personal identifiable information) to Employer through the use of the Company's search engine or any other means for the sole purpose of obtaining and assessing the suitability of Jobseekers in relation to any job vacancy. However, Jobseeker agrees that the Company and its associated companies may use his/her personal data (without his/her name, address and other personal identifiable information) for marketing purposes which may be directed to either potential employers or Employers, their respective agents or anyone under their employment. The Company will not be responsible or held liable in any manner if any Employer, commit breach of the Terms and Conditions, whether in the Republic of India or elsewhere, use the Jobseeker's personal data for any use other than for obtaining potential employees. Jobseeker accepts that personal data given to Employer or other users are given entirely at his/her own risk. Also, the Company reserves the right to terminate any services to any Jobseeker should it become aware of any breach by any Employers and/or Jobseekers.
b. Specific Uses - EmployerUpon payment of the service fee to the Company or upon acceptance of any free trial promotion offer, Employer will be entitled to use the Web Site to advertise job vacancies and/or create their own web page on the Web Site for a predetermined period following agreement of the predetermined service, save and except for free trial promotional offer. Employer will also be entitled to access the Database but agrees that all information obtained shall only be used for the sole purpose of obtaining and assessing the suitability of Jobseekers. Employer acknowledges and agrees that it shall disregard any personal data received from Jobseeker which are irrelevant to obtaining and assessing the suitability of candidates. Employers shall be solely responsible for the contents and materials contained in its advertisement and/or web page.The Company reserves the right to edit any advertisement or web page as it feels appropriate to achieve the purpose stated herein. The Company shall have the right to terminate any services to any Employer and remove any advertisement posted on the Web Sites at the Company's sole discretion, without any compensation or recourse to the Advertiser in the event that the relevant Advertiser or the contents of the relevant advertisement is or are in breach of any of the provisions herein; whereas, in the event that the Company decides to remove an advertisement for any reasons not relating to any breach of the provisions herein, the Company may after deducting the fees charged for the period that the advertisement has been posted on the Web Site, refund the remaining fees (if any) to the Advertisers. The Company also reserves the right to change the service fee or institute new charges or fees, as it deems appropriate. In the event that any Employer fails to pay the service fee or any other fees or charges due to the Company, the Company reserves the right to suspend or terminate the Employer's web page or advertisement, from the site without prejudice to all other rights and remedies.
c. Prohibited Uses - Jobseekers and EmployersJobseeker and Employer agree not to use the Web Site for any of the following purposes which are expressly prohibited :-
i. Jobseeker shall not post any non-resume related information and/or incomplete, false or inaccurate resume related information.
ii. Jobseeker shall not respond to any employment opportunity for any reason other than to apply for the job advertised and Employer shall not respond to any Jobseeker other than in connection with his/her application for a job. Communications soliciting business for any reason is prohibited.
iii. All users shall not print, download, duplicate or otherwise copy or use any personally identifiable information about other users save and except the Database or/and Resumes accessed by the Employer pursuant to Clause 1. as above. All unsolicited communications of any type to users is strictly prohibited.
iv. All users shall not delete or revise any material posted by any other person or entity.
v. All users are prohibited from violating or attempting to violate the security of the Web Site including, without limitation, accessing data not intended for them or logging into a server or account which they are not authorised to access, attempting to probe, scan or test the vulnerability of a system or network or attempting to breach security or authentication measures without proper authorization, attempting to interfere with service to any user, host or network or sending unsolicited e-mail, including promotions and/or advertising of products or services. Violations of system or network security may result in civil and/or criminal liabilities.
vi. All users shall not use the Web Site for transmitting, distributing or storing material in violation of any applicable law or regulation, or in any manner that may infringe the copyright, trademark, trade secrets or other intellectual property rights of others or violate the privacy or publicity or other personal rights of others, or that is libelous, obscene, threatening, abusive or hateful.
vii. The user/subscriber/visitor to jobsnorka.gov.in or affiliated sites(s) is prohibited from introducing/posting or transmitting information or software, which contains a computer virus, or a contaminant, worm or other harmful components on the internet or on jobsnorka.gov.in site or sub-domains or on any affiliate sites or other network system.
6. Copyright, Trademarks etc.
The graphics, images, editorial content and HTML on the Web Site are the intellectual property of the Company and are protected by law relating to copyright, trademark and Information Technology laws and may not be downloaded or otherwise duplicated without the express written permission of the Company. Re-use of any of the foregoing is strictly prohibited and the Company reserves all rights. The user is solely responsible for obtaining, at his own cost, all licenses, permits, consents, approvals and intellectual property or other rights as may be required for using the service.
7. Advertising Material
Part of the Site contains advertising other material submitted to the Company by third parties. Responsibility for ensuring that material submitted for inclusion on the Site complies with the applicable International and National Law is exclusively on the advertisers and the NORKA-ROOTS will not be responsible for any claim, error, omission or inaccuracy in advertising material. The NORKA-ROOTS reserves the right to omit, suspend or change the position of any advertising material submitted for insertion. Acceptance of advertisements on the Site will be subject to the Company’s Terms and Conditions which are available on request.
NORKA-ROOTS will not be liable on account of any inaccuracy of information on this Web Site. It is the responsibility of the visitor to further research the information on the site. Any breach of privacy or of the information provided by the consumer to the Company to be placed on the website by technical or any other means is not the responsibility of NORKA-ROOTS. The Company does not warrant that any resume, advertisement or web page will be viewed by any specific number of users or that it will be viewed by any specific user. The Company shall not in any way be considered an agent of either Employer or Jobseeker with respect to any use of the Web Site. The Company may not monitor its Web Site at all times but reserves the right to do so. The Company takes no responsibility whatsoever for any material input by any user or others and not posted by the Company. All users acknowledge and agree that they are fully responsible for the form, content and accuracy of any resume, advertisement, web page or material contained therein placed by them (as the case may be). The Company shall not be responsible in any way for any decision, for whatever reason, made by any party seeking or posting jobs on the Web Site. WHILST THE COMPANY HAS ENDEAVOURED TO PROVIDE A QUALITY SERVICE TO EMPLOYERS AND JOBSEEKERS, IT DOES NOT WARRANT THAT THE WEB SITE WILL OPERATE ERROR-FREE OR THAT THE WEB SITE AND ITS SERVER ARE FREE OF VIRUSES OR OTHER HARMFUL MECHANISMS. IF USE OF THE WEB SITE OR ITS CONTENTS RESULT IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, BY ANY USER, THE COMPANY SHALL NOT BE RESPONSIBLE FOR THOSE COSTS AND ANY LOSS AND DAMAGE OF WHATSOEVER NATURE. THE WEB SITE AND ITS CONTENTS ARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. 9. Own Risk
All USERS USE THE WEB SITE AND ANY OTHER WEB SITES ACCESSED THROUGH IT, AT ENTIRELY THEIR OWN RISK. 10. Registration and Password
You are responsible for maintaining the confidentiality of your account access information and passwords. You shall be responsible for all uses of your Web Site registrations and passwords, whether or not authorized by you. You are not authorized to share your password or other account access information with any other party, temporarily or permanently, and breach of this obligation may tantamount to disabling the jobsnorka account and Company Services. You agree to immediately notify the Company of any unauthorized use of your Account, and passwords.

The Web Site may contain links to third party web sites. These are provided solely as a convenience to you and not in any way as an endorsement by the Company of the contents on such third-party web sites. If users access any linked third party web sites, it shall be at their own risk. The Company shall not be responsible for the contents of any third party web sites linked to the Web Site and does not make any representations or warranties regarding the contents or accuracy of materials on such third-party web sites. Further any material or details posted in the Web Site by any user may be viewed by users of other web sites linked to the Web Site and the Company shall not be responsible for any improper use by any user or third party from linked third party web sites of any data or materials posted on the Web Site.
12. Fees and Service –Related Agreements
Payments for the services offered by jobsnorka.gov.in shall be on a 100% advance basis. Refund if any will be at the sole discretion of NORKA-ROOTS. The Company offers no guarantees whatsoever for the accuracy or timeliness of the refunds reaching the Customers card/bank accounts. The Company gives no guarantees of server uptime or applications working properly. All services are on a best effort basis and liability is limited to refund of amount only. The Company undertakes no liability for free services. The Company reserves its right to amend / alter or change all or any disclaimers or terms of agreements at any time without any prior notice. All terms / disclaimers whether specifically mentioned or not shall be deemed to be included if any reference is made to them. The Company further reserves its right to post the data on the website jobsnorka.gov.in or on such other affiliated sites and publications as the Company may deem fit and proper at no extra cost to the subscriber / user.The subscription / agreement between the Company and the subscriber / user is not a "non-poach agreement" nor can the same be termed or used as an alternative to "non-poach agreement" in as much as The Company / jobsnorka.gov.in is a public site and all information posted by the Company goes to the public domain except information / data which is specifically assigned a non-public / private character. Any agreement for a subscription / usage entered into by the Company does not confer exclusive of service on any subscriber / user. The Company will not be party to any legal proceedings between a user (e.g. a subscriber) and a party contracted through the site. In case the Company is implicated in any legal proceedings, costs will be recovered from the parties that array the Company. The Company however will abide with any court order duly served on it through due process mandated by law. In case a person using the world wide web/internet receives a spam or virus which includes a link to jobsnorka.gov.in or to any other site maintained, operated or owned by the Company, it should not be held responsible for the same. The Company assumes no responsibility for such mails. The services provided by the websites maintained, operated or owned by the Company do not extend to acting as an agent (express or implied) on behalf of any subscriber or user. The Company has no agents and does not operate through any agents save for those specifically mentioned on the home page of the website.
13. Force Majeure
The NORKA-ROOTS shall have no liability to any user any interruption or delay in access to the site irrespective of the cause. NORKA-ROOTS shall have no liability if performances and services became impossible or impracticable as a result of an event or effect that the company could not have anticipated or controlled.
All users agree to indemnify, and hold harmless the Company, its officers, directors, employees and agents from and against any claims, actions, demands, losses or damages arising from or resulting from their use of the Web Site or their breach of the terms of this Agreement. The Company shall be provided with prior notice of any such claim, suit or proceedings to the relevant user.
15. Limitation of Liability
Without prejudice to the above and subject to the applicable laws, the aggregate liability by the Company to any user for all claims arising from their use of the Company's services and the Web Site shall be limited to the amount of the existing package fee subscribed to and paid for by the user (if any) and operative at that time.
16. Security Measures
The Company will use its reasonable endeavours to ensure that its officers, directors, employees, agents and/or contractors will exercise their prudence and due diligence in handling the personal data submitted by Jobseekers and the access to and processing of the personal data by such persons is on a "need-to-know" and "need-to-use" basis. The Company will use its reasonable endeavours to protect the personal data against any unauthorized or accidental access, processing or eraser of the personal data.
17. Anti-Spam Policy
The subscriber of the Database at jobsnorka.gov.in is subject to the Anti-Spam Policy given below:-The use and access to the Database is subject to this policy. The services provided to users are aimed at providing recruitment solutions and should be restricted to contacting suitable candidates for genuine jobs in existence. Mailing practices such as transmitting marketing promotional mailers/offensive messages/messages with misleading subject lines in order to intentionally obfuscate the original message, are strictly prohibited. The Company reserves the right to terminate services, without prior notice, to the originator of Spam. No refund shall be admissible under such circumstances. Following is an illustrative (not exhaustive) list of the kinds of messages which can be classified as Spam:
i. Unsolicited Bulk Messages/Unsolicited Commercial Messages,
ii. Non job related mails,
iii. Messages with misleading subject lines,
iv. Blank Messages,
v. Extra ordinary high number of mails,
vi. Mails soliciting payments,
vii. Misleading/fraudulent mails.
Users agree to indemnify and hold harmless the NORKA-ROOTS from any damages or claims arising out of usage of their user accounts for transmitting Spam. Users are advised to change their passwords frequently in order to reduce the possibility of misuse of their accounts. 18. Governing Law and Jurisdiction
The Company makes no claims that the content may be lawfully viewed or accessed outside India. Access to the content may not be legal by certain persons or in certain countries.
